Clause 1. General use of the website

By accessing the website at camawake.com or by hiring our services on any official social network (Instagram: https://bit.ly/3lJiLbf / Facebook: https://bit.ly/3PG15uR), you have read, understood and agree to be bound by all of these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree to all of these Terms and Conditions, you are expressly prohibited from using the Site and must stop using it immediately and you are informed that you will not be able to access the services offered through the platform.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are expressly incorporated herein by reference. Camawake reserves the right, at its sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason, which will be published on this website, without prior notice. The modifications will always be public for a later consultation of the user and so that in a timely manner he knows them and decides if he accepts them again.

We will notify you of any changes by updating the "Last Updated" date of these Terms and Conditions, and you waive any right to receive specific notice of each such change.

Clause 2. Access to the site

For customer registration, you will be asked to fill in required fields on a registration form, indicated as such by an asterisk (name, age, phone, emergency contact, injury or illness, etc.). In this case, it is essential that you fill in these fields in order to access the services offered by Camawake. 

You agree that the data submitted and stored in our information systems is accurate and acts as proof of your identity. Please inform us of any applicable changes or errors in said data. 

The registered user may request the rectification, deletion and/or cancellation of their data when they deem it appropriate, in accordance with the procedure for them provided for in the Camawake Personal Data Processing Policy.

In case of non-compliance with the rules described in these Terms of Use, we reserve the right to suspend your access to the Site and any appointment generated for the provision of services. In such a case, we will inform you as soon as possible.

Although we try to maintain the accessibility of the Site, we cannot guarantee access in all circumstances. In fact, and in particular for maintenance reasons, or any other reason beyond our control, access to the Site may be interrupted.

Clause 3. Service contracting procedure

To access our services, customer registration is required. For registration, it is necessary to fill out the registration form, using updated and true data, in all the fields marked as mandatory. Camawake is not responsible if the data provided is not updated or contains an error. It is necessary to determine which boat will be used (from Camawake or from the client) in order to define the date, time, and package to reserve. Once the above is confirmed, you must pay an advance of 25% of the total amount, which can be made by transfer or deposit to the account stipulated in the payment policy section. At the end of the class, the remaining 75% of the package that the client has chosen must be paid inCASH.

The services that Camawake offers are the following:  

1.-camawake boat classes:For this case, you must choose one of the following packages for the classes in Chapala, Jal:

• Package 1: Duration 1 hour // Maximum 2 participants // Includes everything you need  to ski and take the class

• Package 2: Duration 2 hours // Maximum 4 participants // Includes everything you need to ski and take the class

• Package 3: Duration 3 hours // Maximum 6 participants // Includes everything you need to ski and take the class

• Personalized Package: Duration and number of participants to be agreed and price must be quoted.

two.-classes on the client's boat:In this case, a quote must be made based on the number of class hours requested and the location of the class.

   3.1. Cancellations

To make any cancellation, the client must send an email to camarenawake@gmail.com or send a message via WhatsApp to the number 3329382179. The cancellation must be made at least 72 hours prior to the time of the selected class, Once this process has been completed, Camawake will contact you in order to reimburse the payment for the services. In the event that the cancellation is not made within that period, the money already paid previously will not be refunded to the client.  The client can reschedule at any time the class for which he paid in advance, which must be done at least 72 hours in advance.

In the event that there are weather conditions that complicate the development and execution of the class, Camawake reserves the right to reschedule the class, without this generating any type of penalty for the client.

   3.2. payment policy

Payment must be made at the time of scheduling the class and the package chosen by the client. Payment must be made by bank transfer or deposit to the following account:

   3.3. General considerations

3.3.1. Accidents.Due to the nature of the activity to be carried out in class, which implies inherent risks, such as physical and psychological injuries, illnesses, viruses, secondary consequences such as paralysis and/or even death, Camawake disclaims all responsibility and the client assumes all related risks and participates voluntarily and without error in such activities.

The client waives any legal or extralegal action that could be exercised against Camawake, relieving him of any civil or criminal liability.

3.3.2. Security.The security instruments for the development of the class and the activities will be provided by Camawake, for which it is important to follow the indications that the trained personnel indicate. The consumption of any alcoholic beverage, consumption of narcotics and boarding the boats with any glass container or any material that could cause an accident is prohibited. Camawake is not responsible for any accident or injury that may occur due to non-compliance with the instructions of the staff.

 

3.3.3. Puntuality.The client must arrive at the location where the class will be at least 15 minutes before it begins, in order to receive safety and technical instructions for the class. In case of any delay, the lost time will be at the Client's expense, for which reason it will not be possible to extend its established schedule. In the event that the delay is attributable to Camawake, the lost time will not be at the customer's expense and it will be replaced.

3.3.4 Damage to Camawake equipment.In the event that the Client damages any equipment owned by Camawake or any third-party service provider, whether it is superficial or total material damage to the boat, vests, aquatic equipment, among others, he must cover the entire cost of repair or the assumption of total loss of the equipment, the total cost for its replacement.

Clause 4. USE OF THE SITE

The use of the Site implies that you have the necessary hardware and software resources to browse the Internet.

Furthermore, the Internet does not guarantee the security, availability and integrity of data transmissions. Therefore, we cannot be held responsible for errors, omissions, deletions, delays, failures (including, but not limited to, viruses), communication lines, hardware and software not under our control. control or in case of unauthorized use or possible degradation of the content published on this Site.

We defend the values of tolerance and respect for the rights of others. Therefore, this Site must not be used as a vehicle for racist, violent, xenophobic, malicious, obscene or illicit proposals.
